Returns and Refunds

Because Lively House & Home creates customized and made-to-order products, all sales are final. Returns, exchanges, and refunds are not accepted once design work or production has begun.

Once a design has been approved and released for production, changes cannot be made. Clients are responsible for carefully reviewing all proofs, including spelling, dates, addresses, wording, colors, quantities, and other details before approval.

Production and Shipping

Production timelines vary based on the scope of the project, print methods, materials, quantities, and level of customization. Estimated timelines will be provided during the design and ordering process.

Lively House & Home is not responsible for delays caused by shipping carriers, printers, craftspeople, material availability, weather, natural disasters, or circumstances outside our reasonable control.

Once an order has been transferred to a shipping carrier, Lively House & Home is not responsible for loss, theft, delay, or damage occurring during transit.

Payment and Collections

All invoices must be paid according to the payment schedule provided for the project.

Lively House & Home reserves the right to collect any unpaid amounts owed by the Client through lawful means. The Client is responsible for reasonable costs incurred in collecting an outstanding balance, including collection agency expenses and reasonable attorneys’ fees where permitted by law.

Copyright & Intellectual Property

Unless expressly transferred in writing, Lively House & Home retains all copyrights and intellectual property rights in the artwork, designs, layouts, illustrations, calligraphy, monograms, crests, patterns, concepts, proofs, digital files, production files, and other creative work produced in connection with a project, whether registered or unregistered.

The Client receives the finished products for personal use and enjoyment. Purchasing stationery or other finished pieces does not transfer ownership of the underlying artwork or intellectual property.

Clients may display, photograph, mail, share, and enjoy their finished pieces for personal purposes. Clients may not reproduce, modify, trace, copy, extract, sell, license, distribute, or create derivative works from Lively House & Home designs without prior written permission.

Artwork created for one piece may not be independently reproduced or applied to additional stationery, signage, merchandise, websites, printed materials, or other products by the Client or another vendor without written permission from Lively House & Home.

For example, artwork created for an invitation suite may not be extracted and provided to another vendor for use on menus, signage, seating charts, napkins, cups, favors, websites, or other wedding details unless those usage rights have specifically been granted.

Additional licensing may be available upon request.

Artificial Intelligence and Machine Learning

Lively House & Home artwork, designs, illustrations, calligraphy, monograms, crests, patterns, proofs, concepts, photographs of designs, digital files, and other creative materials may not be uploaded, submitted, entered, scanned, photographed for submission, or otherwise provided to any generative artificial intelligence, machine-learning system, image-generation platform, or similar technology without prior written permission from Lively House & Home.

This restriction includes using Lively House & Home work:

* to generate, recreate, imitate, modify, expand, complete, or produce variations of a design;
* as a reference image, style reference, prompt input, training material, dataset, or model input;
* to create derivative artwork, illustrations, monograms, crests, patterns, stationery, signage, or other designs;
* to remove, isolate, trace, reproduce, or reinterpret individual elements of a design; or
* to train, fine-tune, develop, or improve an artificial intelligence or machine-learning model.

The Client may not authorize a planner, designer, printer, stationer, calligrapher, artist, vendor, or other third party to use Lively House & Home work for these purposes.

Possession of a physical product, photograph, proof, PDF, or other representation of the work does not grant permission for artificial intelligence or machine-learning use.

Any use of Lively House & Home intellectual property beyond the rights expressly granted may require additional licensing and payment.

Trademarks

Any trademarks, business names, logos, or other proprietary marks remain the property of their respective owners.

Permitted Use

Unless otherwise agreed in writing, Lively House & Home grants the Client a limited, non-exclusive license to use the finished products created for the Client for personal purposes related to their wedding or celebration.

Internal business information, pricing structures, production files, vendor information, working files, and other proprietary materials may not be shared, reproduced, or distributed without prior written permission.

Artistic Style and Creative Judgment

The Client acknowledges that stationery design, illustration, calligraphy, and other creative services are subjective.

By hiring Lively House & Home, the Client confirms that they have reviewed the studio's portfolio and understand its general style and approach.

Every wedding and project is different. Lively House & Home will make reasonable efforts to incorporate the Client's ideas and preferences while using professional and artistic judgment throughout the design process.

Differences in personal taste or dissatisfaction with artistic judgment alone do not constitute grounds for a refund after services have been performed.

Handmade and Printed Work

Variations may naturally occur in handmade and specialty-produced work.

Letterpress, foil stamping, embossing, handmade paper, calligraphy, deckled edges, hand-applied details, specialty papers, custom painting, and other artisanal processes may contain subtle variations from piece to piece. These variations are characteristic of the materials and methods used and are not considered defects.

Colors may also appear differently between computer screens, digital proofs, printed samples, and final printed pieces.

Calligraphy

Hand-calligraphed envelopes and other calligraphy pieces are individually created. Letterforms, spacing, placement, and composition will naturally vary based on the names, addresses, wording, and proportions of each piece.

These variations are inherent to hand lettering and are part of the finished work.

Clients are responsible for providing complete and accurate address information. Addresses will be written or printed according to the information supplied by the Client unless address-list editing or etiquette review has specifically been included in the project.

Mailing and Postal Delivery

The United States Postal Service and other postal carriers use automated systems to process mail. Handwritten addresses, unusual envelope colors, specialty papers, embellishments, wax seals, vintage postage, envelope thickness, and other design elements may affect processing.

Lively House & Home cannot guarantee delivery of mailed stationery once it has been accepted by the postal service.

Occasional returned, delayed, damaged, or undelivered pieces are possible with any large mailing. Clients should order additional invitations or stationery when appropriate to allow for replacements or late additions.

When Lively House & Home mails stationery on behalf of a Client, responsibility for individual pieces transfers to the postal carrier once they have been mailed.

Lively House & Home is not responsible for reprinting, readdressing, replacing, or reimbursing stationery that is lost, delayed, damaged, returned, or otherwise not delivered by a postal carrier unless otherwise agreed in writing.

Cancellation

A project remains active until the agreed services have been completed and all outstanding balances have been paid.

If a Client chooses to cancel a project after work has begun, amounts already paid may be non-refundable and the Client remains responsible for work completed, materials purchased, production commitments made, and other costs incurred through the date of cancellation.

Specific cancellation terms included in a Client's proposal, invoice, or service agreement will control where they differ from these general website terms.

If repeated attempts are made to contact a Client without meaningful response and the delay prevents reasonable completion of the project, Lively House & Home may consider the project inactive or cancelled and require payment of any outstanding amounts.

Independent Contractors and Production Partners

Lively House & Home may work with trusted printers, craftspeople, manufacturers, artists, assistants, subcontractors, and other production partners when completing Client projects.

Lively House & Home retains control over the creative direction and management of its services while reserving the right to select appropriate production partners for each project.

Limitation of Liability

To the fullest extent permitted by applicable law, the maximum aggregate liability of Lively House & Home arising from a project or the services provided shall not exceed the amount actually paid by the Client to Lively House & Home for the services giving rise to the claim.

Lively House & Home is not responsible for indirect, incidental, consequential, or special damages arising from the use of its services or products to the extent permitted by law.

Indemnification

To the extent permitted by law, the Client agrees to indemnify and hold harmless Lively House & Home, its owners, employees, contractors, agents, and affiliates from claims, damages, liabilities, or expenses arising from materials, information, instructions, artwork, photographs, wording, or other content supplied by the Client or from uses of the finished work that exceed the rights granted by Lively House & Home.

Force Majeure

Lively House & Home will not be responsible for failure or delay in performing obligations caused by circumstances beyond its reasonable control.

These circumstances may include natural disasters, fire, flooding, hurricanes, earthquakes, severe weather, war, terrorism, civil unrest, labor disruptions, transportation interruptions, governmental actions, supply-chain interruptions, widespread utility or technology failures, printer or manufacturer closures, or other comparable events.

When such an event materially affects a project, Lively House & Home will make reasonable efforts to communicate with the Client and determine an appropriate path forward.

Governing Law

These Terms & Conditions and any disputes arising from them shall be governed by the laws of the applicable jurisdiction identified in the Client's individual service agreement or contract.

Severability

If any provision of these Terms & Conditions is determined to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

Changes to These Terms

Lively House & Home may update these Terms & Conditions periodically. Changes will become effective when posted to this website. Terms contained in a signed Client agreement will continue to govern that particular project where they differ from the general website terms.
